Is the End of Another DePuy Pinnacle Trial in Sight?
Hi, this is Stuart Talley here to do another update on the ongoing Pinnacle metal-on-metal hip trial. If you’ve been following your blog, you know that right now we have six individual plaintiffs who are having their case tried to a jury in Dallas, Texas. All of these plaintiffs are New York residents, and the trial so far has really followed the path of all of the other trials. The part of the case where the plaintiffs put on what I call general liability evidence, so evidence that sort of applies to everyone, is coming to a conclusion. Last week and this week there’s going to be a lot of testimony about individual plaintiffs. So the plaintiffs themselves will testify, their family members will testify about their damages, some of the treating doctors, their testimony will be presented to the jury, and the plaintiffs should be done with their case by the end of this week. After that, the defense will start their case. What we have been told is that the defendants intend to call seven witnesses, all of them expert witnesses. So these are people that DePuy has paid to come testify at the trial. Many people have asked what has happened with the jury tampering issue, or I’m sorry the witness tampering issue, that we talked about previously. Right now, we don’t know what’s going to happen with that issue. The judge hasn’t made any decisions. I’m assuming that there is still some type of investigation that’s ongoing, but right now, we don’t know. When we find out we’ll update our blog right away.
