Hi, Stuart Talley here to do an update on the DePuy Pinnacle metal-on-metal hip trial that is currently ongoing in Dallas, Texas. I wanted to follow up on the testimony of a plaintiffs’ expert, Albert Bernstein. Dr. Bernstein is biomedical engineer who is essentially in the business of developing prosthetic and implantable devices for the medical industry.
On direct examination, he spoke about the DePuy metal-on-metal hips and basically gave his opinion that it was a bad idea to put this on the market. He also talked about the individual plaintiffs in the case and gave some opinions as to what caused their injuries from a biomechanical standpoint.
On cross examination, the defense attorney pointed out that Dr. Bernstein is not a medical doctor. He also pointed out that he never studied metal-on-metal hips and has never published studies on metal-on-metal hips. He also made the point that Dr. Bernstein does not diagnose patients. This was intended to undercut his opinions as to what the cause was of the plaintiffs’ injuries.
So, the defense did a good job. They pointed out some lack of qualifications of Dr. Bernstein with respect to the opinions he provided.
